Inventions, Innovations & Patents got just easier! Thanks to Generative AI Technologies?
Generative AI tools used – ChatGPT (GPT 3.5), Google Bard, Microsoft Bing Chat (GPT4).
This article is in two parts. First part focused on what and why inventions and patents can be done through Generative AI tools whereas second part focused on detailed step by step with examples on how to invent or innovate with assistance of Generative AI Tools.
Due to Generative AI, Everything of AS IS state, have already been disrupted and Invention, Innovation and patenting is no exception. By this blog, I am not promoting the new way of doing invention and innovation rather make people aware what's happening around the world and how we've to be cautious using new powerful and revolutionary Technologies like Generative AI.
Part 1 starts here...
Introduction
Have you ever dreamed of creating something new and original, but lacked the time, skills, or resources to do so? Have you ever wondered how to protect your intellectual property and get rewarded for your innovation? If you answered yes to any of these questions, then you might be interested in generative AI technologies.
Considering the widespread awareness and knowledge among those who stay informed, there is no need to elaborate on what Generative AI entails.
Let's get started.
Inventors no longer need to rely solely on their limited knowledge and manual processes to generate new ideas and innovations. Thanks to Generative AI technologies, the invention process has been transformed. It eliminates the need for long brainstorming sessions and extensive discussions among team and mentors. With the assistance of Generative AI, inventors can quickly generate new, useful, and non-obvious ideas and innovations. From idea generation to the submission of patent disclosures, Generative AI streamlines the entire patenting process. This innovation is a game-changer for inventors, making the process up to 10 times easier and faster. It marks a new era in invention and patenting.
Assistance Area
Generative AI technologies can assist inventors and businesses in various stages of inventions and patenting, such as: Idea generation, Prior art search, Patent drafting, Patent filing, Patent Classification, Patent Analysis, Patent prosecution and many more.
Effort and time involved in the entire process can be reduced drastically and hence expedite the patenting process with Generative AI assistance.
New way of inventing and patenting Let's understand this with comparative analysis of Earlier way of invention and patenting versus new way i.e., Generative AI way of invention and Patenting as below table.
Perspective | Earlier Inventions and Patenting | Inventing with Generative AI |
Invention Process | Manual and Human-Driven | Assisted and Augmented by Generative AI |
Idea Generation | Reliant on Human Creativity and brainstorming sessions. Inventors had to come up with new ideas and concepts manually, often based on their domain knowledge and expertise | Generative AI tools assist inventors in idea generation and brainstorming by leveraging large datasets and algorithms. |
Patent Search and Analysis | Patent search and analysis were time-consuming and involved manual efforts. Inventors and patent professionals had to manually search through patent databases and review documents to identify relevant prior art. | Generative AI techniques facilitate faster and more accurate patent search and analysis using Prompt engineering in natural language. AI-powered tools can analyse vast amounts of patent data, identify relevant prior art, and provide comprehensive search results in a fraction of the time. |
Prior Art Identification | The prior art identification process involved manual search conducted by inventors and patent professionals. They relied on their knowledge, expertise, and available resources to search for relevant prior art documents. | The prior art identification process is automated using Generative AI algorithms. AI systems are trained on large volumes of patent and literature databases, allowing them to identify relevant prior art with speed and accuracy. |
Invention Disclosure and Documentation | Inventor writes disclosure manually as per the template, which can be a time-consuming and tedious process. Inventor may miss relevant prior art due to limited knowledge and search capabilities | Inventor writes disclosure manually but can use Generative AI tools to aid in identifying prior art, making the process more efficient and accurate. |
Patent Classification | Patent classification involved manual efforts by experts who assigned relevant classification codes based on their knowledge and understanding of the technology domain. Classification required human interpretation of the patent claims and descriptions to determine the appropriate categories. | AI-based classification systems utilize machine learning algorithms to automatically classify patents. These systems can analyse patent texts, claims, and descriptions to identify the most appropriate classification codes, enhancing accuracy and efficiency. |
Patent Drafting and Filing | Patent drafting was primarily a manual process, with inventors and legal professionals working together to prepare the patent application. The focus was on describing the invention in a clear and concise manner while complying with legal requirements. | AI-supported drafting tools assist inventors and patent professionals in preparing patent applications. AI systems can suggest patent language, provide templates, and help refine the disclosure, saving time and improving the quality of the application |
Patent Examination Process | The patent examination process was conducted by human examiners who evaluated the patent application for novelty, inventive step, and non-obviousness. Examiners relied on their expertise and domain knowledge to assess the patent application and conduct prior art searches. | AI technologies support patent examiners in the examination process. AI systems can analyse prior art, assist in evaluating inventive step and non-obviousness, and provide recommendations to examiners, improving efficiency and consistency |
Innovation and Novelty | Dependent on Inventors' limited Knowledge | AI-assisted innovation by leveraging vast knowledge resources |
Challenges and risks
Generative AI technologies can make inventions and patenting easier by reducing the time, cost, and effort involved in these processes. They can also improve the quality, diversity, and originality of inventions and patent applications. Moreover, they can enable inventors and businesses to access and leverage the vast amount of existing knowledge and data in various domains. However, generative AI technologies also pose some challenges and risks for inventions and patenting. Some of these are:
Exposure of a novel idea: We have to bit cautious in the Prior Art Search, as the key idea might get exposed to outside world. You might take assistance to generate new ideas, brainstorming pointers and analysis content, and preparing patent disclosure but smartly enough.
Sudden load on Invention and Patents submissions: Due to better and efficient approach i.e., the new way of inventing using Generative AI tools, make inventing easier than before. Hence, Inventing and Patenting will become reachable to large number of people than ever before in an exponential level. Suddenly there will be large number of patent submissions. How the handle this load? Probably we need to come up as quickly as possible with structured processes and guidelines for Patenting.
Ethical and legal issues: Generative AI technologies raise questions about the ownership, authorship, and responsibility of the generated content. For example, who owns the intellectual property rights of an invention or a patent application that is created by a generative AI tool? Who is liable for any infringement or damages caused by such content? How can the authenticity and validity of such content be verified?
Quality and reliability issues: Generative AI technologies may not always produce accurate, relevant, or consistent content. For example, it may generate content that is erroneous, misleading, or plagiarized. How can the quality and reliability of such content be ensured and evaluated?
Security and privacy issues: Generative AI technologies may expose sensitive or confidential information to unauthorized or malicious parties. For example, a generative AI tool may leak trade secrets or personal data that are used as input or output for generating content. How can the security and privacy of such information be protected and controlled?
Therefore, generative AI technologies require careful design, development, testing, and deployment to ensure their benefits outweigh their drawbacks for inventions and patenting. They also require proper regulation, governance, and oversight to ensure their ethical, legal, and social implications are addressed.
The only thing Inventor needs to know is how to write prompt correctly. Prompt engineering is the core of this new way of inventing. The better you write a prompt the better you'll get the response content.
Conclusion
In conclusion, generative AI technologies are a powerful and promising tool for inventions and patenting. Just as with any powerful technology, the responsibility and ethical use of generative AI becomes paramount. They can help inventors and businesses create and protect new products, processes, or methods that have practical utility and are not obvious to others in the field. However, they also pose some challenges and risks that need to be considered and managed. By harnessing the potential of generative AI technologies while mitigating their pitfalls, inventors and businesses can foster innovation, economic growth, and social welfare.
